These terms are an agreement between you and AEAN AXIS NET LIMITED (company number 8196557, NZBN 9429049430752), trading as Floor It ("Floor It", "we", "us"). They cover your use of the Floor It website (flooritnz.com) and editor (app.flooritnz.com), together "the service". By using the service, signing in or subscribing, you agree to them. If you use Floor It on behalf of a business, you agree for that business and confirm you can.
1. Your account
- You sign in with a link sent to your email address, so keep access to that inbox secure. You're responsible for what happens under your account.
- Give us a real email address you control, and keep it up to date.
- A Pro subscription is for one person. Don't share your account or sign-in links.
2. Free, Pro and plan passes
Floor It has a free plan, a paid Pro plan, and plan passes, which give one plan Pro for a one-off payment. What each includes is shown in the editor's upgrade screen and on our website. Free exports carry Floor It branding. We may improve, change or remove features over time; if we remove something central to Pro, we'll tell subscribers in advance.
3. Subscriptions, plan passes and payment
- Prices are in New Zealand dollars and include GST. Payment is handled by Stripe.
- Pro renews automatically at the end of each monthly or yearly period, and you're charged for the next period, until you cancel.
- You can cancel at any time under Account in the editor. You keep Pro until the end of the period you've paid for, then your account moves to the free plan. Your plans and brand kit stay in your account.
- We don't give refunds or credits for part periods or unused time, on Pro or on a plan pass, except where the law requires it.
- If a payment fails, Stripe will retry it. If it still hasn't gone through a few days after your period ends, your account moves to the free plan until payment is made.
- If we change the price of Pro, we'll tell you at least 30 days before it applies to your next renewal, so you can cancel first if you'd rather.
- A plan pass is a one-off payment for one plan saved to your account, every floor of it. It gives that plan Pro's features and exports. You can export the plan as often as you like for 7 days from its first Pro export. After that the plan stays in your account, and you can still edit it and export it on the free plan; a further Pro export needs a new pass or Pro. A pass is for the plan it was bought for: it can't be moved to another plan, and deleting the plan ends it.
- If you subscribe to Pro within 30 days of buying plan passes, what you paid for them comes off your first Pro payment, up to the price of one month of Pro. Every pass bought before you subscribe is then used up, so none of them comes off a later payment.
4. Your content
- You own the plans, scans, images and logos you put into Floor It, and the plans you export.
- You let us store, process and display that content only as needed to run the service for you (for example, saving your plan and rendering your exports).
- You confirm you have the right to use everything you upload, including permission from the owner of a floor plan, drawing or photo where one is needed, and that it doesn't break anyone's copyright or other rights.
- Plans can include personal information about other people, such as a client's address. You're responsible for handling that information lawfully, including under the Privacy Act 2020. Our Privacy Policy explains how we handle it.
- Your account keeps the plan you're currently working on. Save your own copy of each plan (Save as a .plan.json file) and of your exports: we don't promise to keep anything else, and you shouldn't rely on Floor It as your only copy.
5. Plans are approximate
Floor It plans are drawings made from images and measurements you supply. They are approximate and are not to scale unless you've measured and checked them yourself. They're for illustrating a property, for example in marketing, and are not suitable for building, renovation, valuation, legal, conveyancing or insurance purposes.
- You're responsible for checking a plan is accurate before you publish or rely on it, and for making sure your use of it (including in property advertising) complies with the law and any rules that apply to you, such as the Fair Trading Act 1986 and the Real Estate Agents Act 2008 and its rules.
- Exported plans include a disclaimer that they're approximate. Please leave it in place when you publish a plan.
6. Acceptable use
Don't use Floor It to break the law or anyone's rights; upload malware or content you're not allowed to share; try to get around plan limits or security; access other people's accounts or data; overload, scrape or reverse-engineer the service; or resell it without our written agreement.
7. Our rights
The Floor It software, design, logos and name belong to us or our licensors. These terms give you the right to use the service, not ownership of it. If you send us ideas or feedback, we're free to use them.
8. Availability
We work to keep Floor It running smoothly, but we can't promise it will always be available, uninterrupted or free of errors. We may need to pause it for maintenance or for reasons outside our control.
9. Consumer law
If you're using Floor It as a consumer (for personal, domestic or household purposes), nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
If you're using Floor It for the purposes of a business (for example as a real estate agent, photographer, property manager or builder), you and we agree that:
- the Consumer Guarantees Act 1993 does not apply, as allowed by section 43 of that Act; and
- sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply, as allowed by section 5D of that Act;
and that it is fair and reasonable for both of us to be bound by this.
10. Liability
To the extent the law allows:
- We aren't liable for any indirect or consequential loss, or for loss of profits, revenue, data, sales or opportunity, however it arises.
- We aren't liable for loss arising from inaccuracies in a plan, or from how you or anyone else uses a plan (see section 5).
- Our total liability to you for anything to do with the service is limited to the amount you've paid us in the 12 months before the claim arose.
If you use Floor It for business purposes, you agree to cover us for any claim brought by a third party arising from content you upload or from your use of plans you make with Floor It.
11. Suspension and closing your account
You can stop using Floor It at any time, and ask us to delete your account by emailing hello@flooritnz.com. We may suspend or close an account that seriously or repeatedly breaks these terms, or if the law requires us to. If we close a paid account for reasons other than a breach of these terms, we'll refund the unused part of your current period. Sections 4, 5, 7, 9 and 10 continue to apply after your account is closed.
12. Changes to these terms
We may update these terms. We'll update the date at the top, and if a change is significant we'll email account holders at least 14 days before it takes effect. If you keep using Floor It after that, the new terms apply. If you don't agree, you can cancel before they take effect.
13. General
These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction. If part of these terms can't be enforced, the rest still applies. If we don't enforce a right straight away, we haven't given it up. These terms, together with our Privacy Policy, are the whole agreement between you and us about the service.
